Real Estate

Real estate is one of those areas of the law where you really need someone locally to help you make sure you are doing everything correctly. When a business has plans for a site, it's more than just about buying the land and building an office or retail space. Of course, the business has all the usual real estate considerations:

Leased Property & Multifamily Housing

The relationship of landlord and tenant is one of the more regulated areas of the law. In cases where property is occupied for commercial purposes, such as space rented to operate a retail business, the parties will generally agree to terms and conditions by themselves that will be incorporated into a rather hefty lease. Even though apartment buildings are built primarily to generate commercial revenue, apartment buildings are nonetheless housing. They are, therefore, subject to much more regulation that retail space or factories. The relationship between a landlord and a tenant is generally memorialized with a much shorter lease and for good reason. Typically, the lease operates as a starting place for the rights and obligations of the parties-with the remainder of the restrictions found in local ordinances and state statutes. Only an attorney familiar with the law in this area can tell you, whether you are the landlord or the tenant, what those unwritten provisions are and how they affect your ability to collect or your obligation to pay rent.
